Drink Driving Conviction

Hi,

I was unfortunately caught drink driving in the N.T some 6.5 Years Ago.

It was a late night I took the long way home and the police pulled me over and breath tested me. I was pulled back to the Police Station and I blew 0.6, they gave me a $90 fine and let me go home with a z Condition.

How long will this be recorded on the Police Justice system?

Is there a national system?

No Option to take a blood test

Hi,

When I was pulled up for drink driving, the police never gave me the option for taking a blood test 2-4 hours later to prove that in fact the breath testing device was accurate. I have read widely about this and the police didn't explain to me my right of taking a blood test. Can I do anything now? It seems to be a stupid question but in hindsight I'd like to know if I had a right to do that and seeing my reading was 0.06 I quite possibly may have been under if I had taken a blood test.

I would also like to know how long the infringement will be recorded in the Integrated Justice System in the N.T? Will there be a conviction recorded against me in the N.T? I know drink driving is a serious offence, however this seemed to be a bit picky.

Without researching NT law, I can't answer NT specific questions.

the police never gave me the option

In Victoria there is no obligation on the police to inform you about the options that parliament has made available to you under the legislation.

Ask for a copy of your record in the NT and see if it is on it for starters.

NT Drink Driving Laws

HI,

THanks for your replies, just for your information, I spoke to a solicitor in the N.T and they advised that it takes 10 years for a drink driving traffic infringement to be wiped off the justice system. Apparantly the N.T is the only place in Australia where this happens. My case was borderline and the Police where quite leanient and willing to let me drive home after they gave me the infringement.

Apparantly all sweet according to the N.T, my only problem is do I say I was pulled up for drink dringin in Australia on a Victorian Licence?

I guess the person who is asking the question is expecting an honest answer. Your choice is to tell the truth or give them crap or just leave it blank. Can't see how the court records in NT have anything to do with it.

Is it an insurance application? It sounds like the questions they asked me over the phone when I got insurance on my motor vehicle.
