Free
Consultation
Free
consulations with a traffic
lawyer:
I can provide a free 30 minute
consultation if you have been charged
with any of the following offences:
- driving whilst suspended
- driving whilst disqualified
- unlicensed driving
- dangerous driving
- careless driving
- drink driving/drug
driving/refusals
- speeding
and
you intend to plead guilty to those
charges,
and you want legal
representation at court.
I do not provide free consultations to
people who want me to help them win
their court case.
What
happens at a free
consultation?
At a free consultation lawyers
generally do the following:
- obtain your contact
details,
- ascertain
what charges you are facing (without
analysing the charges),
- read
the summary of facts alleged against
you (if it has been
provided),
- listen
to you explain your version of what
happened at the time of the
offence,
- listen
to you explain why you think the law
is unfair,
- listen
to you explain why you think the
court should give you a
break,
- encourage
you to believe that fighting the
charges is a waste of
time,
- encourage
you to believe that pleading
guilty is the only practical thing
you can do,
- tell
you that pleading guilty will
somehow make things better for
you,
- tell
you that a lawyer is required to
help you to plead
guilty,
- claim
that they are the best lawyer to
save you from jail,
- explain
to you the costs of legal
representation,
- sign
a fee agreement with
you,
- arrange
for payment of fees,
- obtain
information required to present the
plea of guilty,
- advise
you what you need to do to ensure
the plea of guilty proceeds
smoothly,
- spend
60 seconds explaining what will
happen at court,
- tell
you what sort of penalty you should
expect,
- arrange
a suitable date for the plea of
guilty to take place.
What
does NOT happen at a free
consultation?
At a free consultation lawyers
generally do NOT
do any of the following:
- obtain
and read the police brief
(containing the police evidence) in
detail,
- use
years of skill and experience
defending traffic cases to find a
defence to your charges,
- obtain
from the police a copy of the police
brief (including all the witness
statements), read it in full
and find a defence within
it,
- check
the charge and summons for
defects,
- check
to see if all provisions of the
Magistrates Court Act have been
complied with,
- inspect
the court file,
- check
to see whether all steps taken by
the police are lawful,
- provide
you with advice as to how you can
win your case,
- advise
you why pleading not guilty is often
in your best interets,
- tell
you whether an expert witness can
help you to win your
case,
- research
points of law that could result in
your acquittal,
- rely
on years of winning traffic cases,
and winning Supreme Court appeals,
to map out for you a strategy for
success,
- negotiate
with the police to have some or all
charges dropped,
- negotiate
with the police to reduce the
severity of charges,
- negotiate
with the police to amend the summary
of facts that will be alleged in
court,
- give
any consideration at all to the fact
that every defendant in every case
has a chance of being
acquitted,
- develop
a strategy to improve your situation
and to avoid the penalties and
consequences that follow from
pleading guilty.
If
you are looking for the above services,
a free consultation is not for you. You
should book a $250 conference
instead.
