Last night i was at the intersection turning right onto flinders under the bridge coming from crown casino when the light went orange i braked quickly as I didnt want to risk it and came to a stop halfway into the pedestrian crossing a micro second before the light went red.As soon as the light went red i got the 2 flashes but i had stopped completely.
Does this sound right?Am i likely to get fined or was it taking a photo as i had tripped the sensor?

Sorry, I don't understand why he should check the letterbox.
57 Stopping for a yellow traffic light or arrow
If you cannot stop before the stop line (c) then you must remain stationary isn't this correct. So isn't the issue here if the driver could stop safely. So could no the driver assert that he could not stop safely and provide a reason and this would need to be accecpted as the images could not disprove this?

An infringemetn notice may or may not arrive.
If it doesn't, you don't have to do anything and any effort spent researching this is a total waste of time.
If it does, start researching then.

Not being able to stop safely is never a winnable defence to a red light infringement.
In my opinion you might get a fine. And there is also a chance you won't. Hope that clarifies things for you.

Re: Flashed whilst stopped at Red Light
the cameras support the concept of a "screeching stopper", so IMO now you're up for someone in (Serco?) to look at the pics, and deciding if you entered the intersection on red or not. if you really did come to a stop in time no big deal. The sensors are generally in the ground before the intersection line so it's possible to come to a screeching stop over the sensors, but not actually make it into the intersection.
Some other jurisdictions demand that you also hit a sensor out in the intersection to prove you did the wrong thing (but that's not relevant to you in VIC).

What if stopping puts you in danger Hardy?
E.g there is a B double on your tail, that isn't going to stop in time, is that an excuse to proceed through a red light?

If you've got proof that a truck was right behind you and it also entered the intersection then this might work.
See http://classic.austlii.edu.au/au/legis/ ... s322r.html
It won't be enough to just tell the Magistrate you were worried about getting hit by the truck behind you without anything to convince the Magistrate that an accident would have occurred if you had stopped.

Re: Flashed whilst stopped at Red Light
A while back i went through an intersection i know well CNR Nepean Hwy and Warrigal Roads) and can anticipate the change of lights from red to green The two sets of lights close together (always in sync) on one occasion i went through a bit faster than normal (not speeding) and was forced to stop at the second set where the camera is, and had to stop as the light was still red. I crossed the triggers as i pulled up on the pedestrian crossing and got the double flash. I do not know whether i was stationary or not but I didn't get an infringement notice. That was late 2019
