Alleged Speed (QLD)

Postby olev » Wed Mar 14, 2018 11:47 pm

Gday,
I was recently pinged by a Victronic roadside camera near Gladstone in Central Qld.
The Offence: Exceed speed limit by at least 13kph but not more than 20kph.
The infringement claims a detected speed of 73kph and an alleged speed of 73kph in a 60kph zone.
I wrote to the Traffic Camera Office and suggested the penalty should have been the lower one due to inherent camera error.
Ref. AS 4691.2 - Laser-based Speed Detection Devices - Operational Procedures.
I received a reply today, which said the infringement stood.
They said the camera was correctly calibrated and the photo taken in accordance with QPS policy.
They also said <if you require the specifications for the VICTRONIC PoliScan speed camera system, please contact
Vitronic Machine Vision Australia Pty Ltd, Unit 10, 27-33 Thornton Crescent, Mitcham, VIC.
The QPS does not own the intellectual property rights to these documents.>
Unlike Victoria, it seems Queensland does not make any allowance for error.
I'm inclined to take this to court. Any suggestions or precedents would be appreciated.
Cheers

Hardy

Why bother? Even if you convince a court there is a calibration inaccuracy you will still get found guilty etc.
How many demerit points will 2kmh save?

Sorry Hardy, new here, I wasn't aware of the interstate section.
I am more interested in the fairness than the $ and points.
At 73kph, with any error at all, there is a 50/50 chance whether the infringement deserves to be in the first or second penalty level.
I feel I should have been given the benefit of the doubt.
Your writeup on 'detected and alleged speed' was the reason for my original inquiry.

cheers
