Ute tailgate

A colleague asked if there is an offence in driving her ute with the tailgate in the 'down' (i.e. horizontal) position. She's researched it as best she can, to the point of calling police who couldn't give her an answer. She needs to move a couch and can fit it in the tub, but only with the tailgate down.

I know the number plate will still need to be visible - modern utes tend to mount the plate in the bumper which is well below the tailgate, so at least it will still be in its usual position. I suppose the question may be whether or not the tailgate obscures the registration plate.

Are any VicPol members aware of infringements being issued and why? Sean - I don't suppose you've had any clients with this issue?

I’ve never had any problems driving with the tailgate down on my landcruiser.

As long as the number plate is still visible as per the requirements then it OK to do it.

The issue you may have is complying with the vertical arc of 45 degrees as per Road Safety (Vehicles) Regulations 2009, 48(1)(d)
