Getting a copy of the brief of evidence
Hi
How do I go about getting a copy of the brief of evidence?
Do I need to subpoena it? Can I ask for it? Do I ask the prosecutor or the magistrate?

So in one post you assert that the expert evidence is irrelevant, yet you don't even know what evidence is being lead against you?
Brief is normally supplied by the informant with the summons but it doesn't have to be, however you can ask for a copy in writing prior to the mention date from the informant or at the mention date ask the prosecutor.

Just ask the prosecutor at the mention date. Hes sure to have a spare there for you. The criminal procedure act is the ultimate forest destroying paper waster.

Slattery your so right, i have a draw full of court paperwork. most of it could be condensed into sheet that shows or tells you how to get the information online. the brief could be done as well by a letter that said ring this number talk to this person for ID vero. and your given a code to down load your brief that is only valid of ten minutes while the opperator watches the file leave the system. to easy

The whole brief system in this day and age should be compiled online with the legal fraternity downloading the relevant paperwork once the brief has been authorised.
The amount of paper wasted for a brief of evidence in 2012 is ridiculous.

It still needs to be printed at our end, so that just passes the printing costs to us.

but sean how many copies of the bit about an interparator do have in files in your fliing cabinet? not to mention all the bits that are "information" but really not really case related?

Get compatible inks.... They are like $2 - $4 ea.

Why does it need to be printed? If it is electronic, then can't you just download it to your iPad or laptop, and refer to it as needed?

It is inconvenient showing a witness a laptop and then tendering the laptop. You could end up without your laptop for many weeks or months if the case does not end in one day.

I hear prosecutors are using tablets now. You'll be able to compare now and brag when yours is more powerful than theirs
