Complaint against a taxi driver

Last week I suffered a hit and run from a taxi driver.
I reported it to the VTD who replied as follows:


The issue that have been raised in your correspondence is an offence under the Victorian Road Safety Act 1986 and if substantiated, the driver can incur a penalty and/or loss of demerit points. Whilst the VTD will address the inappropriate conduct of the taxi driver, it should be noted that breaches of the Road Safety Act are required to be witnessed by an authorised officer.


Well, it is news to me that a driver can not be liable for a traffic offence unless an authorised person witnessed the offence! I am sure many of my clients will be wondering how they ever got convicted of drink driving when the only evidence they were driving at the time of an accident came from the civilian motorist they ran into.

It's a poorly written response, but do you think the police would do or say much different if you reported a general breach of the road safety act to them.

Most likely they are under staffed and don't have the resources to follow up every compliant they get, The VTD is pretty well feared by taxi drivers, so they must be doing something right

So what happen, any more follow up?

Hit and runs are almost never witnessed by an authorised officer.
I've prepared an application for preliminary discovery from the VDT. Thinking about adding vpol as well.
